This means families can often inherit unused pension funds without paying IHT.<\/li>\n\n\n\n<li>Many pensions include a feature called \u2018death benefits\u2019, which allows the remaining money in your pension pot to be passed on when you die. These benefits are usually free from IHT and don\u2019t count towards the value of your estate.<\/li>\n\n\n\n<li>Death benefits are typically tax-free if the deceased was under 75. If they were 75 or over, the recipient may need to pay income tax on the benefits, but no IHT.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-new-rules-from-april-2027\">New rules (from April 2027)<\/h3>\n\n\n\n<p>From <strong>6 April 2027<\/strong>, the UK government will tighten how IHT is applied to unused pension savings and death benefits. The aim is to ensure that pensions are used primarily for retirement income rather than inheritance planning.<\/p>\n\n\n\n<p>Key highlights include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Unused pension pots and death benefits<\/strong> under UK registered pension schemes, (including both <a href=\"https:\/\/www.gov.uk\/pension-types\">defined contribution and defined benefits schemes<\/a>) will be included in the deceased\u2019s estate for IHT purposes.<\/li>\n\n\n\n<li><strong>Tax rate: <\/strong>in the 2025\/26 tax year, the standard IHT nil-rate band is \u00a3325,000. In addition to this, you have a maximum residence nil-rate band of \u00a3175,000, meaning your overall IHT allowance could increase to \u00a3500,000. Both the nil-rate band and residence nil-rate band rates have been frozen until 2031. Like the standard nil-rate band, you can transfer any unused portion of your residence nil-rate band to your surviving spouse or civil partner when you die. Overall, a couple could potentially pass on up to \u00a31m before inheritance tax becomes due. The residence nil-rate band is tapered by \u00a31 for every \u00a32 that your estate exceeds \u00a32m.<\/li>\n\n\n\n<li><strong>Exemptions: <\/strong>while unchanged, pension death-in-service benefits will remain exempt from IHT. <a href=\"https:\/\/www.gov.uk\/government\/publications\/dependants-scheme-pensions\">Dependants\u2019 scheme pensions<\/a> and <a href=\"https:\/\/www.gov.uk\/hmrc-internal-manuals\/pensions-tax-manual\/ptm073900\">charity lump sum<\/a> death benefits will also remain exempt.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-who-could-be-affected\">Who could be affected?<\/h3>\n\n\n\n<p>These changes are likely to impact:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Individuals with pension savings<\/strong> who plan to leave unused funds to their loved ones.<\/li>\n\n\n\n<li><strong>Beneficiaries inheriting estates<\/strong> that include pensions and exceed the IHT threshold.<\/li>\n\n\n\n<li><strong>Estates that were previously below the IHT threshold<\/strong> but may now become liable due to the inclusion of unused pension funds.<\/li>\n<\/ul>\n\n\n\n<p>The government estimates that around 38,500 estates will pay more IHT under these new rules, and an additional 10,500 estates that were not previously liable for IHT will face a tax bill.<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a><\/p>\n\n\n\n<p>If you have substantial pension savings, these changes could reduce the amount of wealth your loved ones inherit. For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If you have \u00a3500,000 in unused pension funds, and your estate exceeds the IHT threshold, the IHT bill on your total estate could be up to \u00a3200,000 (40%).<\/li>\n<\/ul>\n\n\n\n<p>The responsibility for reporting and paying IHT will remain with the personal representatives \u2013 the person legally responsible for managing the deceased\u2019s estate and already tasked with handling IHT.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-changes-to-agricultural-property-relief-apr-and-business-relief-br\">Changes to Agricultural Property Relief (APR) and Business Relief (BR)<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-current-rules-0\">The current rules<\/h3>\n\n\n\n<p>APR and BR are tax reliefs designed to help families keep their farms and businesses intact without having to sell assets to pay IHT.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>APR: <\/strong>reduces the taxable value of qualifying agricultural property, such as farmland or farm buildings.<\/li>\n\n\n\n<li><strong>BR: <\/strong>reduces the taxable value of qualifying business assets, such as business premises or shares in private companies.<\/li>\n<\/ul>\n\n\n\n<p>Currently, both APR and BR offer <strong>unlimited 100% tax relief<\/strong> on qualifying assets, meaning no IHT is due on them.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-s-changing\">What\u2019s changing?<\/h3>\n\n\n\n<p>From <strong>6 April 2026<\/strong>, the government will introduce new limits&nbsp; on how much APR and BR can reduce your IHT liability. These are the key changes:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>\u00a32.5 million cap on 100% relief&nbsp;<\/strong><\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Each individual will have a <strong>\u00a32.5 million allowance<\/strong> for assets that qualify for 100% APR or BR (or both combined).&nbsp;<\/li>\n\n\n\n<li>This allowance is <strong>per individual but can be transferred<\/strong> to a spouse or civil partner, so couples could benefit from 100% relief on up to \u00a35 million.<\/li>\n\n\n\n<li>For example, if you own \u00a33 million in qualifying assets, only the first \u00a32.5 million will qualify for 100% relief.<\/li>\n<\/ul>\n\n\n\n<p>2. <strong>50% relief for excess value<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any qualifying assets above the \u00a32.5 million allowance will only receive 50% relief, instead of 100%.<\/li>\n\n\n\n<li>For example, if your farm is worth \u00a33 million, \u00a32.5 million will be fully exempt from IHT, but the remaining \u00a3500,000 will only receive 50% relief. This means \u00a3250,000 will be taxable at 40% (\u00a3100,000).<\/li>\n<\/ul>\n\n\n\n<p>3.<strong> Reduced relief for Alternative Investment Market (AIM) shares<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Currently, shares that are \u2018not listed\u2019 but traded on recognised stock exchange markets qualify for 100% relief, as they are considered unquoted. A key example of this is shares listed on the AIM market. However, from April 2026, these shares will qualify for BR at 50% instead of 100%.<\/li>\n<\/ul>\n\n\n\n<p>4. <strong>Trusts get their own allowance<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trusts created&nbsp;before 30 October 2024 have their own&nbsp;\u00a32.5 million allowance&nbsp;for tax relief.Trusts created&nbsp;after this date&nbsp;share the \u00a32.5 million allowance with other trusts set up by the same person.<\/li>\n\n\n\n<li>Trusts created&nbsp;after this date&nbsp;share the \u00a32.5 million allowance with other trusts set up by the same person.<\/li>\n\n\n\n<li>The \u00a32.5 million allowance for relevant property trusts will refresh every 10 years, so that qualifying agricultural and business property held in that trust benefits from 100% relief up to a value of \u00a32.5 million on each 10-year anniversary charge.<\/li>\n<\/ul>\n\n\n\n<p>5. <strong>Life tenant trusts share allowances<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trusts where a beneficiary has the right to income (known as&nbsp;Qualifying Interest in Possession trusts) will share the \u00a32.5 million allowance with the beneficiary\u2019s personal estate when they pass away.<\/li>\n<\/ul>\n\n\n\n<p>6. <strong>Transitional rules for transfers<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Transfers of qualifying assets made between&nbsp;30 October 2024 and 6 April 2026&nbsp;will initially be assessed under the current rules.<\/li>\n\n\n\n<li>However, if the original owner passes away within&nbsp;seven years, the new rules will apply retroactively.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-who-could-be-affected-0\">Who could be affected?<\/h3>\n\n\n\n<p>These changes could impact individuals with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Farms or agricultural property:<\/strong>&nbsp;if the property is not actively farmed or rented for agricultural use, it may no longer qualify for APR.<\/li>\n\n\n\n<li><strong>Family businesses:<\/strong>&nbsp;businesses with investment-focused activities, such as property letting, may lose eligibility for BR.<\/li>\n\n\n\n<li><strong>Diversified operations:<\/strong>&nbsp;farms or businesses with mixed activities (e.g. farming combined with tourism or renewable energy projects) may face reduced relief.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-next-steps\">Next steps<\/h2>\n\n\n\n<p>Now is the time to understand how these reforms could affect your estate and take proactive steps to protect your wealth. Here\u2019s how you can prepare.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Review your current investment and IHT strategy<\/strong><\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong style=\"font-size: 1rem;\">Pensions in your estate plan<\/strong><span style=\"font-size: 1rem;\">:&nbsp;understand the role of pensions in your estate strategy as they will become less tax-efficient for inheritance planning. You may need to work with your wealth manager and\/or tax adviser to explore alternative strategies to help achieve your goals.<\/span><\/li>\n\n\n\n<li><strong style=\"font-size: 1rem;\">Your personal representative<\/strong><span style=\"font-size: 1rem;\">:&nbsp;review who you\u2019ve chosen to manage your estate in your will. Ensure they\u2019re prepared for any new responsibilities, especially with changes to IHT rules.<\/span><\/li>\n\n\n\n<li><strong style=\"font-size: 1rem;\">Agricultural and business property<\/strong><span style=\"font-size: 1rem;\">:&nbsp;assess the value of your qualifying assets and how much currently benefits from APR or BR \u2013 your wealth manager can support you with this.<\/span><\/li>\n<\/ul>\n\n\n\n<p>2. <strong>Consider alternative options<\/strong><\/p>\n\n\n\n<p>Explore strategies to reduce your estate\u2019s IHT liabilities while passing on more of your wealth to loved ones. Some options include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Gifting assets<\/strong>:&nbsp;making <a href=\"https:\/\/www.rbcwealthmanagement.com\/en-uk\/insights\/tax-efficient-gifts-and-seven-year-rule\">gifts during your lifetime<\/a> can reduce the size of your taxable estate.
