For most people, a basic will is the starting point of their plan, but 33 percent of adults don&#8217;t have one, according to a survey by caring.com. In some cases, a will is all that&#8217;s required to share your wishes with your beneficiaries. But for more complex estates, a trust can be a valuable tool.<\/p>\n\n\n\n<p>\u201cA will manages what happens to your assets after death, but a trust goes into effect as soon as you sign the paperwork,\u201d says Cyndy Ranzau, wealth strategist with RBC Wealth Management-U.S. \u201cA trust can dictate what happens while you&#8217;re alive. You can put in provisions to address what you&#8217;d like to happen if you become incapacitated, such as spending your wealth on long-term care in your home.\u201d<\/p>\n\n\n\n<p>People may be more familiar with a will than a trust and assume that a will alone represents a complete estate plan, says Leslie Williams, wealth strategist with RBC Wealth Management-U.S.<\/p>\n\n\n\n<p>\u201cMany people think they don&#8217;t have enough money to open a trust, but anyone with assets to manage could benefit from a trust,\u201d says Williams. \u201cIf you have insurance policies, retirement plans with designated beneficiaries and real estate with joint ownership, you don&#8217;t need a will or a trust to ensure those assets go to your heirs when you pass away. But if you have assets outside of those items, a trust provides a way to effectively administer them.\u201d<\/p>\n\n\n\n<p>For some, having both a will and a trust is ideal, says Williams.<\/p>\n\n\n\n<section class=\"wp-block-rbcwm-rbc-block rbc-block rbc-block-well rbc-block-small rbc-block-grey has-block-grey-background-color has-background\"><div class=\"\"><div class=\"row \"><div class=\"col-lg-12\">\n<h4 class=\"wp-block-heading\" id=\"h-evaluate-your-retirement-income-strategy\">Evaluate your retirement income strategy<\/h4>\n\n\n\n<p class=\"is-style-intro\">Are you on track for retirement? A revocable trust, also known as a living trust, can be created by an individual or jointly by a couple. The creators of the trust, known as grantors, are typically the same as the trustees, says Ranzau. The grantors should identify successor trustees who will manage the assets if the grantors become incapacitated or pass away. The grantors also name the beneficiaries of the trust when it&#8217;s established.<\/p>\n\n\n\n<p>\u201cThe beauty of a revocable trust is that it can be changed while the grantors are alive,\u201d Ranzau says. \u201cAn irrevocable trust, on the other hand, cannot be changed.\u201d<\/p>\n\n\n\n<p>Irrevocable trusts are typically used to manage gifts and mitigate taxes, says Williams.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-when-is-a-trust-beneficial\">When is a trust beneficial?<\/h2>\n\n\n\n<p>A will is the simpler option for estate planning, but it needs to go through probate after you pass away, which can take time. Assets in a trust don&#8217;t need to go through probate and can be distributed according to the trust&#8217;s terms more quickly, explains Williams.<\/p>\n\n\n\n<p>Here are some ways in which a trust could be supplemental to your will in your estate planning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><b>Protect your privacy:<span>&nbsp;<\/span><\/b>With only a traditional will in your plans, your beneficiaries must wait for a court-supervised probate. \u201cProbate is part of the public record, which will include your will, a list of your property, the value of your property and a list of your beneficiaries with their addresses,\u201d says Williams. \u201cAnyone can pull that information from court records and perhaps contact your heirs because they&#8217;ll know how much they inherited and where they live.\u201d A trust provides privacy because the court record will only list the trust, not the assets in the trust or the beneficiaries. \u201cIf you&#8217;ve written someone out of your will or decided to leave all your money to your dog or to a charity, that&#8217;s part of the public record of a will,\u201d adds Ranzau. \u201cIf you outline those decisions with a trust, no one can find out.\u201d<\/li>\n\n\n\n<li><b>Control your assets while you&#8217;re alive:<\/b><span>&nbsp;<\/span>A revocable trust allows the trustees to choose how their assets are managed during their lifetime, explains Ranzau. \u201cMany people want to know that the money they&#8217;ve saved will be spent on their care if they become ill rather than having someone decide to send them to the nearest Medicaid home to preserve the assets,\u201d she says. \u201cIf you don&#8217;t want your kids to make those kinds of decisions while you&#8217;re alive, instructions in a trust can reduce potential friction.\u201d<\/li>\n\n\n\n<li><b>Manage property in multiple states:<\/b><span>&nbsp;<\/span>A prime reason to create a trust is to manage multiple real estate holdings, says Ranzau. \u201cIf you own your primary residence in Maryland, a beach house in South Carolina and a cabin in West Virginia, your beneficiaries will have to go through a long and potentially costly probate process in all three states if you use a will to handle those assets,\u201d Ranzau says. \u201cPutting each property into your trust requires transferring the deed, but that&#8217;s easier on your beneficiaries and less expensive than going through probate several times.\u201d<\/li>\n\n\n\n<li><b>Manage the distribution of unusual assets:<\/b><span>&nbsp;Some assets, such as mineral rights, oil and gas rights and even timeshares, can be difficult to value, especially if they&#8217;re in multiple locations, says Ranzau. If those assets are handled with a will, probate could be extremely complicated and expensive because of valuation issues, she says.<\/span><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-steps-to-establish-your-will-and-trust\">Steps to establish your will and trust<\/h2>\n\n\n\n<p>Typically, your wealth planner and estate planner will discuss options for how you want to manage your assets in the context of your family configuration, dynamics and goals.<\/p>\n\n\n\n<p>\u201cAs soon as you have assets to manage, you should be talking about a will and trusts,\u201d says Williams. \u201cWe talk with our clients about whether they want to make gifts to charities and family members during their lifetime and about how they would like their beneficiaries to inherit their assets.\u201d<\/p>\n\n\n\n<p>Once the decisions have been made about a will, revocable trust or an irrevocable trust, clients have their attorneys prepare the documents.<\/p>\n\n\n\n<p>\u201cA simple will can be done quickly, but a trust may take days, weeks or months to complete depending on the circumstances, the clients and their lawyers,\u201d says Williams. \u201cIt&#8217;s important to remember, too, that a living trust is not a permanent document.
